All Intellectual Property Rights are territorial, meaning you are protected in your home country. So if you register a UK trade mark, it does not give you the right to stop someone else using the same brand name in the USA or another country. There are, however, various International Agreements between States which give you certain wider protections automatically initially. These come into play as soon as you apply for your UK or EU trade mark. The structure they set up makes it easier for you to access international protection. However, this is only for a limited period and is subject to you filing for protection in your desired countries within 6 months. International Trade Mark application We provide registrations worldwide. Many countries may be included by way of a Madrid Protocol application. See the list of countries that are within the Madrid System. There is further information in our branding whitepaper, which you may request by using the form on the right of this page. What next? Get your trade mark underway as soon as possible. |
